I am writing to you in your capacity as Chairman of the Western and Central Pacific Fisheries Commission (WCPFC). In accordance with paragraph 21 of the Summary Record of the First Session of the Western and Central Pacific Fisheries Commission (WCPFC/Comm.1/8), which was held December 9-10, 2004 in Pohnpei, Federated States of Micronesia, the United States hereby advises the Commission that it intends, consistent with its policies and to the extent possible under its domestic law, to follow the procedures listed in paragraph 3 of the decision relating to Cooperating Non-Members, contained in Annex II of WCPFC/PrepCon/46.

Moreover, I am pleased to announce that on May 16, 2005 President Bush submitted the WCPF Convention to the United States Senate. In doing so, the President recommended that the Senate provide early and favorable consideration to the Convention and give its advice and consent to ratification. In accordance with the U.S. Constitution, the United States may only assume legal obligations under the Convention after having received such advice and consent of the Senate. Until such time as the United States completes its domestic procedures for membership, we look forward to participating actively in the work of the WCPF Commission as a Cooperating Non-Member.

As Chairman of the WCPFC, please be assured that the United States offers its full support in your efforts to guide the new Commission in its important work.
