A Norfolk federal grand jury has indicted Andrew Marvin Warren, 42, of Norfolk, Va., on resisting arrest, firearms and narcotics charges. The grand jury charged Warren with one count of forcibly resisting, impeding, and interfering with federal law enforcement officers, one count of possessing a firearm during a crime of violence, and one count of possession of a firearm by an unlawful user of controlled substances.

Neil H. MacBride, United States Attorney for the Eastern District of Virginia, made the announcement after the indictment was returned today. Warren faces a maximum penalty of eight years on the resisting count, up to life imprisonment on the charge of possession of a firearm in the commission of a violent crime, and five years on the charge of possession of a firearm by an unlawful user.

According to the indictment, on April 26, 2010 in Norfolk, Warren was using a narcotic-controlled substance while he possessed a Glock Model 19, 9mm semi-automatic pistol. Further, while federal and local law enforcement officers attempted to place Warren under arrest, he was in possession of the loaded firearm. Warren resisted and impeded as many as five agents who were attempting to place him under to arrest.

This case was investigated by the Norfolk ATF, the Norfolk United States Marshals Service, the Department of State Diplomatic Security Service, and the Norfolk Police Department. Assistant United States Attorney Stephen W. Haynie is prosecuting the case on behalf of the United States.

Criminal indictments are only charges and not evidence of guilt. A defendant is presumed to be innocent until and unless proven guilty.
