On June 28, 2011, the Republic of Ecuador instituted arbitral proceedings against the United States concerning the interpretation and application of the Treaty between the United States of America and the Republic of Ecuador Concerning the Encouragement and Reciprocal Protection of Investment, August 27, 1993, pursuant to Article VII of the Treaty. In an award dated September 29, 2012, the Tribunal, by majority, dismissed the case for lack of jurisdiction, “due to the absence of the existence of a dispute falling within the ambit of Article VII of the Treaty."
